Welcome to ChexList. By accessing or using our application, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using ChexList, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our service.

2. Description of Service

ChexList is a checklist application that helps users create, manage, and share lists for travel, shopping, and everyday tasks. Features include:

• List Management: Create, edit, and organize checklists with categories and subcategories.
• AI-Powered Features: Smart Add (parse text into items) and Smart Review (suggest missing items) powered by Google Gemini.
• Weather Integration: View weather forecasts for travel destinations via Open-Meteo.
• Offline Support: Access and modify lists without internet connectivity.
• Sharing: Collaborate on lists with others.

3. User Accounts

To use certain features of ChexList, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You may sign in using Google Sign-In or email/password authentication.

4. User Content

You retain ownership of the content you create in ChexList (lists, items, notes). By using our service, you grant us a limited license to:

• Store, process, and display your content to provide the service
• Send your list data to third-party AI services (Google Gemini) when you use AI features
• Transmit destination coordinates to weather services when you enable weather features

You agree not to use the App to store or transmit illegal, offensive, or harmful content.

5. AI Features and Third-Party Services

ChexList uses third-party services to provide certain features:

A. Google Generative AI (Gemini)

When you use Smart Add or Smart Review features:

• Your list content and trip details are sent to Google's Gemini API.
• AI-generated suggestions are provided as-is and may not always be accurate.
• You are responsible for reviewing and accepting AI suggestions.
• Your data is not used to train Google's public AI models.

B. Open-Meteo Weather API

When you add a destination to a travel list:

• Geographic coordinates are sent to Open-Meteo to retrieve weather forecasts.
• Weather data is for informational purposes and may not be fully accurate.

C. Link Scraping

When you paste URLs into the app:

• URLs may be sent to our cloud function to extract metadata.

6. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Upload malicious code or content
• Impersonate others or misrepresent your affiliation
• Abuse AI features (e.g., excessive requests, attempting to manipulate outputs)
• Use the service to scrape, harvest, or collect data for unauthorized purposes

7. Rate Limits and Fair Use

To ensure service availability for all users:

• AI features (Smart Add, Smart Review) have daily usage limits.
• Feedback submissions are rate-limited to prevent abuse.
• We reserve the right to throttle or suspend accounts that exceed fair use limits.

8. Beta Program

If you participate in our beta program:

• You understand the service may contain bugs or errors
• Features may change or be removed without notice
• We may contact you for feedback
• Data created during beta may not be preserved after launch
• The beta program is invitation-only and we reserve the right to limit access

9. Intellectual Property

ChexList and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws. This includes but is not limited to:

• The ChexList name, logo, and branding
• App design, code, and user interface
• AI prompts and suggestion algorithms

10. Disclaimer of Warranties

ChexList is provided "as is" without warranties of any kind, either express or implied. Specifically:

• We do not guarantee that the service will be uninterrupted, secure, or error-free.
• AI-generated suggestions may be incomplete, inaccurate, or inappropriate for your needs.
• Weather forecasts are provided by third parties and may not be accurate.
• Offline functionality depends on your device's storage and may have limitations.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use of or inability to use the service
• Reliance on AI-generated suggestions
• Inaccurate weather data or forecasts
• Loss of data or unauthorized access to your account
• Any items forgotten during travel despite using the app

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice in the app or sending an email. Your continued use of the service after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your account at any time for violations of these Terms. You may also delete your account at any time through the app settings. Upon termination:

• Your access to the service will be revoked.
• Your data may be deleted in accordance with our Privacy Policy.
• Shared lists you created may become inaccessible to collaborators.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
